SOMESHA Education Support Cover
Effective 18 August 20261. About this Agreement
These Client Terms of Service and Agreement ("Terms") govern your registration for and use of the Somesha Education Support Cover ("Cover") provided by Goodwill Capital Limited under the Somesha brand ("SOMESHA", "we", "us" or "our"). Somesha is powered by Mobishule Technologies.
By registering for the Cover, making payment, or accepting these Terms electronically, you confirm that you have read, understood and agreed to these Terms.
2. Eligibility and Registration
You must provide accurate and complete information during registration. Where the Cover relates to a child or beneficiary, you confirm that you are legally authorised to provide the information and register that person.
We may request additional information or documentation to verify identity, eligibility or a claim.
3. Education Support Cover
The Cover is designed to provide financial support towards eligible education-related claims, subject to the applicable Cover terms, conditions, exclusions, waiting period and claim requirements.
- Annual Premium: KSh. 3,600
- Maximum Claim Payable Per Term: KSh. 10,000
- Waiting Period: 3 months
These benefits do not guarantee payment of every claim. Claims remain subject to eligibility, verification, applicable exclusions and the applicable Cover terms.
4. Premium Payment
The current annual premium is KSh. 3,600. Payment may be made through:

Retain your payment confirmation. Cover activation is subject to successful payment confirmation and completion of the applicable registration requirements.
5. Waiting Period
A waiting period of three (3) months applies. Claims arising during the waiting period may not be payable unless expressly stated otherwise in the applicable Cover terms.
6. Claims
Claims must include information and supporting documentation reasonably required to assess the claim. We may verify information and request additional documents where necessary. Claims are assessed in accordance with the applicable Cover terms.
7. Fraud and Misrepresentation
Fraudulent claims, forged documents, deliberate misrepresentation or attempts to obtain benefits through deception are prohibited. Appropriate action may be taken in accordance with applicable law.
8. Account Security
You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account. Notify us promptly if you believe your account has been accessed without authorisation.
9. Communications
We may contact you using the information you provide for registration, account verification, payment confirmation, Cover administration, claims, service notices, important changes and customer support. Optional marketing communications will be handled in accordance with applicable law and your consent choices.
10. Data Protection
Your personal information will be processed in accordance with the Somesha Privacy & Data Protection Notice. Please read that Notice before completing registration.
11. Changes, Suspension and Termination
We may update these Terms where reasonably necessary, including because of changes to the Cover, technology, business operations or applicable law. We may suspend or terminate access where permitted by the applicable Cover terms or law, including in cases of fraud, material misrepresentation, unlawful use or non-payment.

13. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Kenya, subject to mandatory rights and remedies available under applicable law.
14. Acceptance
By accepting these Terms electronically, you confirm that the information you provide is accurate and that you are authorised to register yourself and/or the child or beneficiary identified in the application.
SOMESHA Privacy & Data Protection Notice

SOMESHA ("SOMESHA", "we", "us" or "our") is a product of Goodwill Capital Limited and is powered by Mobishule Technologies. We respect your privacy and are committed to protecting personal information entrusted to us.
This Notice explains how we collect, use, store, disclose and protect personal information when you register for or use the Somesha Education Support Cover, visit our website, communicate with us, or otherwise interact with our services.

3. Information We May Collect
- Full name and identification information, including National ID details where required.
- Telephone number, email address and other contact details.
- Beneficiary or child information necessary to administer the Cover.
- Payment references and transaction information. We do not need your M-PESA PIN.
- Information and documentation required to assess and process claims.
- Technical, security and website information where necessary to operate and protect our services.
4. Why We Process Your Information
We may process personal information to create and manage your account, register and administer the Cover, verify identity and eligibility, confirm payments, assess claims, communicate with you, provide customer support, prevent fraud, maintain records, improve services and comply with legal or regulatory obligations.
5. Legal Basis
Depending on the circumstances, processing may be based on your consent, performance of an agreement, compliance with a legal obligation, protection of vital interests or another lawful basis recognised by applicable Kenyan data protection law.
6. Children's Information
Where the Cover involves a child, information must be provided by a parent, guardian or other legally authorised person where required. We will take appropriate measures to protect children's information and will not knowingly use it for unrelated purposes.
7. Sharing Personal Information
Where reasonably necessary and permitted by law, information may be shared with payment providers, technology and hosting providers, communication providers, claims or verification providers, professional advisers, auditors, regulators, government authorities or law enforcement agencies. We do not sell your personal information.
8. Cross-Border Processing
Some technology, hosting or service providers may process or store information outside Kenya. Where information is transferred outside Kenya, applicable safeguards and requirements under Kenyan data protection law will be applied.
9. Data Security
We use reasonable technical and organisational safeguards designed to protect personal information against unauthorised access, loss, misuse, alteration, disclosure, destruction and other unlawful processing. No internet-based system can be guaranteed to be completely secure.
10. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including contractual, legal, regulatory, accounting and dispute-resolution requirements. When information is no longer required, it will be securely deleted, anonymised or otherwise disposed of in accordance with applicable law.
11. Your Data Protection Rights
Subject to applicable law, you may have rights including the right to be informed, access your personal information, object to certain processing, request correction, request deletion where legally applicable, withdraw consent where processing is based on consent, and exercise other rights provided by Kenyan data protection law.

13. Marketing Communications
Where required, we will obtain appropriate consent before sending marketing communications. You may withdraw marketing consent at any time. Service-related communications necessary to administer your account or Cover may still be sent where legally permitted or required.
14. Data Breaches
Where a personal data breach occurs, Somesha will assess and respond in accordance with applicable law, including any required notifications.
15. Changes and Complaints
We may update this Notice from time to time. If you have concerns about how your information is processed, contact us first at info@somesha.org. You may also have the right to lodge a complaint with the Office of the Data Protection Commissioner where applicable.
